Public Order Act 1986 provides this :-
"A person is guilty of affray if he uses or threatens unlawful violence towards another and his conduct is such as would cause a person of reasonable firmness present at the scene to fear for his personal safety."
So any drunken cockwomble being a general arse-piece which frightens bystanders can, in theory, be charged. Unlikely now though, but still possible. Give it about 10 years, and it may not even be considered a real crime any more ..... it won't be the first.
Skulls, in theory, Stokes could face 3 years max in chokey - but since our justice system is so rubbish, I reckon he'll probably get a suspended sentence.

Brads, we both know this shit kicks off every weekend in one town or another, and normally bugger all happens of any legal consequence. A combination of a famous name and CCTV footage flashed the world over by a national paper meant it wouldn't go away quietly.
Remember someone also ended up with a fracture (most affrays don't, of course).
Now, whilst I don't know whether his brief will get an acquittal, if he doesn't, then he's damned by the camera. It wasn't handbags ... it was (as I think it was Lardy said) a full clockwork orange episode.
If convicted, the violence alone justifies jail time. With a £1.5 million+ IPL contract and presumably several hundred K England contract even the maximum fine available is little more than a minor inconvenience. That said, actual imprisonment would look awfully like excessive punishment for being famous, but a suspended jail sentence combined with anger management with a trick cyclist may just curb his drunken tendencies.

Like you said. It will at least be very interesting. The fact that the fine is insignificant compared to his potential worth may be a factor. Though I imagine he's not the first rich dickhead to run foul of the law like this.

beams, given the legal definition of affray, I can only imagine it's the charge the CPS felt most likely to result in conviction. As a layman I personally can't imagine a single defence to justify acquittal *on this offence*
It's quite possible there are reasons ABH or GBH may not result in a guilty verdict.

I've been watching the footage, the first chance i've had. Stokes would have been destroyed had he gone after anyone who knows how to fight. His methods left himself wide open and he was lucky he picked on a couple of blokes who hadn't a clue how to handle a half drunk, swinging thug. We've got several 17/18 year olds at our gym who would have put him out of cricket for some time had he picked on them. I am appalled at him and i suggest he joins a boxing and martial club like ours, that usually has a great effect on most pseudo street fighters who come along to learn temper control and self defence when it's really needed, not just because you think you can hurt another person. Great player and he needs to be in the team but also a numpty.

Open and shut case, he's clearly going to be found guilty (should be anyway). The only question is what punishment he gets. As a first offence in this country most people would get a suspended sentence but as he's a celebrity they might give him worse to set an example.
