Re: The charge against Harby
Bullshit. ESPN not getting the cricket as contracted, wouldn't be CA's fault, and I doubt any court would convict them (unless Procter's judge). If anyone, the BCCI would have been sued for flouncing off. ESPN have a contract with almost every other cricket board other than the BCCI. Why they would pander to the people who have been rejecting their bids for TV coverage for some years, and upset the people who have been a very imprtant part of their income? Keeps making less sense every minute.

Re: The charge against Harby
unless you like some subi-bashing of course
at the moment the only facts are this
1. aus have downgraded their charge from racial abuse to general abuse
2. bhajji has accepted he is guilt of non-racial abuse
all the rest is just speculation, incl threats and fines and possible pay-outs. aus and its players have come out looking much the poorer in this exchange

Re: The charge against Harby
EPSN probably could charge both sides, neither wants a massive lawsuit, both sides back off. It's all about money and it stinks.

What exactly is everybody crying about? Harbhajan was unfairly convicted and this unfairness was corrected on appeal.
The matter should be put to bed and everyone should group hug.

From the Age:
Cricket Australia feared India would pull out of the tour, and that broadcaster ESPN, which owns the lucrative contract to beam cricket from Australia into the subcontinent, would sue the board for a figure believed to be as high as $60 million. Cricket Australia told the players it could take a decade to recoup those losses.
BCCI and ESPN working together to get Harby off the hook. Nice.
I wonder what Channel 9's stance would be. Presumably their contract with Cricket Australia stipulates a particular number of matches to be televised.

Re: The charge against Harby
Yeah but I'm not sure about the suing bit; don't the lawyers make contracts to always have get out clauses? And where has the $60M figure come from? Lost revenues?

I don't see how anyone could sue CA when it would be the Indians pulling out and not fulfilling their contract. I think it's all a load of twaddle.

That being the most relevant point, which I naturally missed. Wouldn't all CA have to do is to send their players out to one game, and with the Indians missing, claim that they fulfilled their part of the contract?

Re: The charge against Harby
I don't think it's a question of 'suing' .. the contract stipulates that if under any circumstance the tour does not proceed as scheduled or is cancelled due to unavoidable circumstances then CA is obliged to refund ESPN to tune of $60 million or $XX million whichever is higher.

It's all media cr@p, all sorts of rubbish will be churned out over the next few days, unless you here it from the horses mouth it's either total boll0x or a story with extra masala on top of it.

Well, if that's the case, then all CA has to do is sue the BCCI for damages incurred by the Indians pulling out.

The other thing I don't understand about all this, unless I've missed something, is why Harby has still been fined. Has he admitted to saying something? If the recordings don't contain anything Harby said, racist or otherwise, then how is there any proof of wrong-doing?

I should have saved the page on imageshack. For a moment I was like shattered that Dello could do that.
Eowyn had asked me what my real name was .. she doesn't know so I shouldn't call her by her real name. I typed out my real name and when I hit 'Send' I got message that 'You have been banned from the forum'.

Because he was found guilty of a lesser charge, abusive language not racism.
