I just remember readin in an Indian newspaper that CA's lawyer had told the players that the charge would not stand in a federal court since there were no evidences. and then Indian could countercharge them for god knows what.

Still Australian players went ahead with the charge. You read the report.

As he was found not guilty of uttering the word 'monkey', I don't see how it matters whether it's level 3 or level 4 or whatever.
