Because our accusation, when I read it last, is that Hogg called someone a 'bastard, which is a racist abuse in India'. I am paraphrasing, not giving an exact quote, from some unnamed Indian official.
Looking ahead, it weakens what I think so far is the validity of what we are saying. To begin with bastard ain't racist in India, far as I know. And they'll be laughed out of the ICC offices for complaining about 'bastard' on a cricket field, and most neutral observers will find it difficult not to laugh along. This takes attention away from our position. We don't need this, IMO.
Still would be nice to get final confirmation on what the serious charges against Hogg are, apart from mediocre bowling.

I think the argument is Hogg abused the players family when he called him bastard, which is also a level 3 offence probably.

They aren't idiotic enough to claim 'bastard' is racist. Atleast I hope they're not. Most of what I've heard and seen seem to say Hogg abused Kumble like that, and Kumble has reported that as abusing his family. Don't know for sure it's Kumble though.

I think the point was that "bastard" is an extremely insulting term in India (rather than racist)...cultural sensitivities etc. etc: whereas in Oz it is almost a term of endearment don't you know?

Not sure he said that. If he did, it could have something to do with English not being his first language. He said that India were badly affected by umpiring decisions. He also said that Australia received some bad decisions as well, but if it had been 50-50, India wouldn't have lost the match.
