just to put this topic to bed...Tres didn't cheat and even if he did its just like the blatant pitch tampering that the batsmen do all the time.
I can supply a TRUCK full of mint if the Poms can promise to play the kind of ENTERTAINING cricket that they did in the Ashes 05.

Well 2 things..... Tres didn't cheat... when he clearly did. Even the ICC agrees.
And just because other players cheat in different ways doesn't mean that what he does is OK.

What Afridi did in the test match at Faisalabad- THAT was cheating.
What Athers did in 1994- THAT was cheating
2- Obviously 2 wrongs don't make a right but how come we never question the batsmen when they OPENLY tamper the pitch with their bats?
Please give the bowlers(especially fast bowler) a BREAK..

The Laws of cricket stop a batsman from damaging a pitch ...and allow for debris to be swept from the pitch and the repair of footholes ...which is what the batsman doing some "gardening" is classified as ...If a player is actually damaging a pitch when gardening , then it is against the Laws

A lot of times they do the gardening after being beaten by a good length ball by a FAST bowler,they go and mess around with the area where the ball landed so why is that NOT illegal?

It depends on what they do ...and where they do it ....

Surely all that matters is that the Poms thought they were cheating when they were using the mint thing.
If they didn't than Jones wouldn't have had his hissy fit when Bracken first mentioned it and Tresco wouldn't have had a panic picking up the mints when they fell out of his pocket in 2001.
