Reports are that the hearing is still not over. Four and a half hours and still going on. 12:30 a.m. in Sydney, a few Australian reporters and a rather number of Indian media are waiting outside SCG.
And both the sides are fighting over each and every minor argument on the field. So it now seems all gloves are off.

Would have thought the hearing might have been over by now if there was no evidence that Harbajhan had said anything with racist connotations ... no case to answer.

I guess all of the shit from the match is now hitting the fan. Who would be in the meeting? Obiously Bhajji, Symonds, Procter, Ponting. Who else....I guess Kumble is there, and the Indian manager. The 2 umpires as well. Maybe even a foxy young lass with a very short skirt serving drinks and biscuits every now and then.

INDIA has lodged a counter-claim of abuse against the Australians during Harbhajan Singh's racial discrimination hearing.
The Indians alleged that Brad Hogg referred to an Indian player as a "bastard", which is considered to be a highly offensive term in India. The charge appeared to be an attempt to pick apart Australia's argument that "monkey" was a racially charged word; a stance the Indians have challenged.
"I don't think that word (monkey) was used on the ground, but it is not a derogatory word in India," said Indian team manager Chetan Chauhan last week in outlining India's case in defence of Harbhajan.
The hearing into Hogg's conduct will be held separately from Harbhajan's case, and possibly as early as today. Indian captain Anil Kumble yesterday criticised the behaviour of the Australian players, although the counter-charge against Hogg is believed to have taken the Australian camp by surprise.
Harbhajan's hearing, meanwhile, carried into the early hours of this morning in the SCG Members' Pavilion, with players from both sides lining up to testify. Matthew Hayden, Michael Clarke, Adam Gilchrist, Ricky Ponting and Andrew Symonds told match referee Mike Procter last night that Harbhajan called Symonds a "monkey" during the 116th over of India's first innings.
Ponting is also understood to have told Procter that Harbhajan made an identical taunt towards Symonds during a one-day match at Mumbai's Wankhede Stadium in October. A number of spectators were pictured in monkey poses during that game, won by India, and were subsequently arrested. The Australians made no formal complaint of Harbhajan's actions at the time.
Early today, India's players were still testifying before Procter.
Harbhajan's batting partner at the time of the confrontation, Sachin Tendulkar, was the star witness for the Indians, while Kumble, Chauhan and media manager Dr M. K. Shridhar all appeared in support of the spinner.
The Indian case was helped by the fact that neither Steve Bucknor nor Mark Benson — the on-field umpires during the Sydney Test — heard Harbhajan goad Symonds. Furthermore, Channel Nine technicians were unable to unearth any video or audio evidence to support Australia's complaint.
Harbhajan was charged with breaching section 3.3, pertaining to the use of "language or gestures that offends, insults, humiliates, intimidates, threatens, disparages or vilifies another person on the basis of that persons race, religion, gender, colour, descent, or national or ethic origin".
Indian board chairman Sharad Pawar has tried to avoid a damaging political feud with Australia over Harbhajan's alleged taunt.
Speaking from Mumbai last night, Pawar called for calm and said he was determined to preserve strong ties between the nations.
"There is an extremely good relationship between the countries. There has been a conflict on the field and an issue has been reported by some players, but I don't want to react," Pawar said. "It is important it should not spoil the relationship between the countries or the teams. That is not our desire."
Australian captain Ricky Ponting received strong endorsement from the Australian Cricketers Association for making a formal complaint about Harbhajan.
ACA chief executive Paul Marsh said he was "staggered" that Ponting had been criticised for his action. "He should be applauded, not criticised, for having the courage to take a stance against racism," Marsh said.

Also on parallel there are reports and speculations coming out that if Harbhajan is banned for 3 matches then the Indian team might forfeit the rest of the series.

No way will they forfeit it, but they will appeal it. And frankly if Bhajji is banned just on the word of the Australian players over Sachin and Kumble then it's a farce.

Well that would be ridiculous, they would have to banned from the ICC test table if they did that.
It would defeat the purpose of having a disciplinary committee(with appeal processes in place) if the offending team can just have a whinge and take the ball home if they don't get cleared.
